This End User License Agreement ("Agreement" or "EULA") is a binding legal contract between you ("User" or "Licensee") and Set Sidekick ("Licensor," "we," "us," or "our") governing your access to and use of the Set Sidekick mobile application for iOS devices. By downloading, installing, or using Set Sidekick, you agree to be bound by the terms of this Agreement.

1. Acknowledgement

You and Set Sidekick acknowledge that this Agreement is concluded between you and Set Sidekick only, and not with Apple, Inc. ("Apple"). Set Sidekick, not Apple, is solely responsible for the Set Sidekick application and the content thereof.

2. Scope of License

Set Sidekick grants you a limited, non-transferable, non-exclusive, revocable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. In-App Purchases & Subscriptions

• Payment Processing: Payment for auto-renewable subscriptions or digital items will be charged to your Apple ID account at confirmation of purchase.

• Auto-Renewal: Subscriptions automatically renew unless auto-renew is canceled at least 24 hours before the end of the current billing period.

• Account Settings: You can manage, change, or turn off auto-renewal options at any time by navigating to your Apple ID Account Settings after purchase.

• Refunds: All financial transactions, billing inquiries, and refund requests are handled directly through Apple in accordance with Apple's refund policies.

4. Maintenance and Support

Set Sidekick is solely responsible for furnishing maintenance and support services for the application. You and Set Sidekick acknowledge that Apple has no obligation whatsoever to provide any maintenance or support services with respect to Set Sidekick.

5. Warranties & Disclaimers

Set Sidekick is provided "as is" without warranty of any kind. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application.

6. Product Claims & Intellectual Property

Set Sidekick, not Apple, is responsible for addressing any claims relating to the application or your possession and use of the application, including:

• Product liability claims.

• Any claim that the application fails to conform to applicable legal or regulatory requirements.

• Claims arising under consumer protection or privacy legislation.

• Investigation, defense, settlement, and discharge of any third-party claim that the application infringes a third party's intellectual property rights.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Beneficiary

You and Set Sidekick acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
